PRO Brewing – Terms of Sale (Made to Order)
These terms apply to all BrewTaurus PRO equipment — brewhouses, fermenters, unitanks, bright beer tanks, glycol cooling, control panels, CIP and ancillary systems — sold by BrewTaurus s.r.o., Sanderova 1616/16, 170 00 Prague 7, Czech Republic, Reg. ID 09676872, VAT CZ09676872 (“BrewTaurus”). They complement our general Terms of Service and prevail over them for PRO equipment. The binding terms for a specific order are these terms together with the quotation and pro-forma invoice issued for that order.

1. Business customers
PRO equipment is professional equipment intended for business customers (breweries, brewpubs, restaurants, kombucha producers and other entrepreneurs). By ordering you confirm that you are purchasing for business purposes. Where a consumer nevertheless purchases PRO equipment, the consumer’s mandatory statutory rights under Czech and EU law apply and prevail over any conflicting provision of these terms; in that case please note that equipment manufactured to your specification is exempt from the 14-day right of withdrawal (Directive 2011/83/EU, Art. 16(c); § 1837(d) of the Czech Civil Code).
2. Made-to-order model
PRO equipment is manufactured to order and is not held in stock. Each unit is built to the configuration you confirm in writing — voltage and heating power, port positions, manway, platform, branding and, where applicable, the customised general arrangement drawing. Nothing enters production until you have approved the configuration and drawing. By approving the drawing you confirm that the equipment fits your site: doorways and access route, floor load, utility positions and clearances. Changes requested after approval require our written agreement and may affect price and lead time; the costs of such changes are borne by you.
3. Ordering, prices & payment
Components (fermenters, unitanks, bright beer tanks, glycol tanks, chillers, control panels, CIP carts, malt mills) can be ordered online with full payment at checkout. Complete systems and brewhouses are quoted individually; quotations are valid for 14 days unless stated otherwise. After you confirm the quotation we issue a pro-forma invoice. Production starts on receipt of a 50% deposit; the balance is due before dispatch from the manufacturing site, after we have sent you the pre-shipment test-run documentation (photos and video). Freight is quoted per order and invoiced with the balance unless included in the quotation.
Prices are in EUR and include Czech VAT for EU delivery; customers with a valid EU VAT number are invoiced at 0% VAT under the reverse-charge mechanism. Payment by bank transfer to the account stated on the pro-forma invoice (online orders: the payment methods offered at checkout).
If the balance is not paid within 14 days of our notice that the equipment is ready for dispatch, we may charge storage at 1% of the order value per commenced week. If the balance remains unpaid 60 days after that notice, we may cancel the order, retain the deposit as compensation for costs incurred, and dispose of the equipment.
4. Lead times
Typical delivery is approximately 12–18 weeks from receipt of the deposit (or full payment) and approval of the drawing: standard components typically 12–16 weeks, complete systems and items requiring drawing approval typically 14–18 weeks, in each case including manufacturing, sea freight and customs clearance. Lead times are estimates, not guaranteed dates; we confirm a production slot with each order and keep you informed. Time spent on drawing approval or on changes requested by you, public holidays at the manufacturing site and events beyond our reasonable control extend the schedule accordingly. We are not liable for losses caused by delay. If delivery is delayed by more than 8 weeks beyond the confirmed estimate for reasons within our control, you may cancel the order and receive a full refund of amounts paid; this is your sole remedy for delay.
5. Delivery, import & transport damage
BrewTaurus is the importer of record. Equipment is shipped by sea to an EU port, cleared for import by us, and delivered onward to your address DAP (Incoterms 2020) unless otherwise agreed. You receive an EU invoice and have no customs formalities on your side. Delivery is kerbside: the truck must be able to reach your address; unloading, positioning and moving the equipment into the building are your responsibility unless tail-lift, crane or positioning services are expressly included in the quotation. Single units are shipped in export wooden crates.
Risk passes to you on delivery. Inspect the shipment on arrival before signing. Any transport damage must be noted on the carrier’s delivery document (CMR/POD) at the time of delivery and reported to us with photographs within 48 hours; claims against the carrier cannot be pursued otherwise and we cannot accept liability for damage not documented in this way. Title to the equipment remains with BrewTaurus until payment in full.
Customs duties and import charges applicable on the date of the quotation are included in our prices. Should new or increased customs duties, anti-dumping or countervailing duties, carbon border charges or comparable public charges on the equipment enter into force between the order date and import, we may pass the documented additional cost on to you; if the increase exceeds 5% of the order value you may instead cancel the order against a refund of amounts paid less costs already incurred.
6. Site readiness, installation & commissioning
You are responsible for site readiness: electrical supply of the required voltage and rating, water supply, floor drain, load-bearing floor, ventilation, access route and any permits required by local regulations. Installation — positioning, electrical connection and utility hook-up — is carried out on site by you or a qualified technician engaged by you, in accordance with the operation manual and local regulations; electrical connection must be made by a licensed electrician. We provide an installation guide and guide the commissioning (first fill, pressure checks, control set-up, first brew) live by video call. On-site commissioning by our technician can be quoted separately. We are not liable for damage or non-performance resulting from site conditions, installation not carried out in accordance with our documentation, or operation outside the specified parameters.
7. Warranty
Main vessels carry a warranty of 3 years (5 years where stated on the product page); fittings, electrical and moving components 1 year; wear parts and consumables (gaskets, seals, sight-glass glazing, heating elements, lamps) are excluded unless defective on delivery. The warranty period runs from delivery. The warranty covers manufacturing and material defects under normal operating conditions and is fulfilled, at our option, by repair, supply of replacement parts (dispatched by air) or replacement of the unit. Labour, travel and on-site work are not included unless agreed. Excluded: damage from improper installation, transport after delivery, misuse, inadequate cleaning or maintenance, unsuitable water or cleaning chemicals, unauthorised modification, and operation outside the specified pressures, temperatures or electrical parameters. To claim, e-mail info@brewtaurus.com with the serial number, photographs and a description of the fault; we respond within 24 hours on business days.
8. Compliance
BrewTaurus places PRO equipment on the EU market under its own brand and is responsible for its compliance documentation. All PRO equipment is CE marked and delivered with an EU Declaration of Conformity, an operation manual in English and, for product-contact vessels, a declaration of compliance for food-contact materials. Pressure-rated vessels (2.0 bar working pressure) are manufactured under a PED 2014/68/EU Module H quality system to EN 13445 and ship with a serial-numbered EU Declaration of Conformity identifying the specific unit. Local requirements at your site (electrical inspection, pressure-equipment registration or periodic inspection where applicable, hygiene approvals) are your responsibility; we supply the technical documentation needed for them.
9. Changes, cancellation & returns
Because equipment is built to order, cancellation after production has started is subject to the costs already incurred; the deposit is non-refundable once manufacturing has commenced, and any costs exceeding the deposit are payable by you. Before production starts, the deposit is refundable less documented preparation costs (drawings, engineering, reserved production slot). Made-to-order equipment is manufactured to your specification and is not eligible for return or exchange; this does not affect your rights in respect of defective goods.
10. Liability
To the extent permitted by law, BrewTaurus is not liable for indirect or consequential loss, including lost production, lost profit, loss of ingredients or product, or costs of substitute equipment. Our total liability arising from an order is limited to the price paid for that order. Nothing in these terms limits liability for death, personal injury, intentional misconduct or gross negligence, or any liability that cannot be limited by law.
11. Force majeure
Neither party is liable for failure or delay caused by events beyond its reasonable control, including natural disasters, epidemics, war, strikes, port congestion, carrier or shipping-line failures, changes in trade regulation, or governmental measures. Affected deadlines are extended for the duration of the event. If the event lasts longer than 3 months, either party may cancel the affected order; amounts paid are refunded less costs already incurred.
12. Governing law & disputes
These terms and every order are governed by the laws of the Czech Republic; the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded. The parties will first seek an amicable resolution; failing that, the courts of Prague, Czech Republic, have exclusive jurisdiction. Consumers may also use the Czech Trade Inspection Authority (Česká obchodní inspekce, coi.cz) for out-of-court dispute resolution.
